The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 7 (a) of the P.C. Act Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He submits that there is specific allegation against the husband of the petitioner who has already been granted regular bail by a coordinate Bench of this Court. He submits that neither the petitioner who was working as Supervisor Child Development Project, Gaunaha, was apprehended by the trap team nor any bribe money was recovered from her possession. He further submits that petitioner has no criminal antecedent as

Learned APP for the State and learned counsel for the Vigilance oppose the prayer for bail and submit that the allegation against the petitioner is very grave and serious in nature as being government servant, she was allegedly demanding bribe money for discharge of her official duties through her husband and was also caught red handed while accepting the bribe amount of Rs. 13,500/- from the informant. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, her prayer for anticipatory bail is rejected in connection with Vigilance (Patna) P.S. Case No. 40 of 2022.

However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order considering the fact that there is no specific overt act against the petitioner and she is lady.
