ANJANA MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/406 of the Indian Penal Code and Section 138 of the N.I. Act. Learned counsel for the petitioner submits that he had been the middle-man in the negotiations between the parties in sale and purchase of the land and the deal between the vendor and the vendee did not materialised. As the consideration money could not be made available, the land in question was not sold and the vendee returned the amount due to the vendor.

No.53645 of 2015 (6) dt.13-05-2016 P2/2 So far as the petitioner is concerned, it is submitted that though the petitioner has returned the money vide Annexure-2, to this application, the security cheque given to the complainant was not returned and the same was placed for encashment in the concerned bank, only with the intention of roping in the petitioner. In view of the nature of allegations made and also that it was not the petitioner who had entered into the sale agreement, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Complaint Case No. 1018/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
