2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 132, 109, 310(5), 310(4) of the Bhartiya Nyaya Sanhita, 2023 and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.
3. The case of the prosecution, in short, is that police received information that certain miscreants are arriving with an intention to commit loot. It is alleged that when police reached at the place of occurrence, six persons on two bikes started fleeing away. When they were intercepted by the police, they started firing. In counter, police also fired. Three persons were caught, out of whom one of the accused had received gun shot injury.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.57479 of 2025(2) dt.02-09-2025 2/2 petitioner is not named in the F.I.R. Name of petitioner transpired on the basis of confessional statement of co-accused. No arms and ammunition was recovered from the possession of petitioner.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that this petitioner along with other accused persons made indiscriminate firing on police party, deterred public servants from discharging their duty and has got one criminal antecedent.
6. Considering the nature and seriousness of accusations, prayer for anticipatory bail of the petitioner is refused.
