Petitioner seeks bail in connection with Nawada Town P.S. Case No. 422 of 2014 for offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that an impersonator has taken Rs. 560000/- from the various villagers on account of marriage of girls and has duped about 7080 villagers. The said imposter has been caught by the villagers but managed to flee away.

No.2699 of 2018 (3) dt.15-02-2018 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and the name is also different as the petitioner is not Bipin Kumar. It is submitted that no T.I. Parade has been done and that charge-sheet has been submitted and the petitioner is languishing in judicial custody since 28.11.2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 422 of 2014, subject to the conditions that: (1) One of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
(2) If the petitioner indulges in an offence of similar nature in future,
Patna High Court Cr.Misc. No.2699 of 2018 (3) dt.15-02-2018 3/3 the prosecution will be at liberty to move the learned court below for cancellation of his bail bonds.
