JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of Dihri (T) P.S. Case No. 347 of 2019, disclosing offences under Sections 147, 149, 337, 325, 353 of the Indian Penal Code.

Allegation as per F.I.R. is that while the encroachment proceeding was going on, petitioner no. 1 alleged to have instigated the local people and on her instigation about 25 persons including all the petitioners started pelting stones on the

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and no specific allegation has been attributed tot hem and they are ready to abide by any condition imposed on them. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Dihri, Rohtas, in connection with Dihri (T) P.S. Case No. 347 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
