The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 467, 468, 420, 409, 120B of the Indian Penal Code. The prosecution case is that the husband of the petitioner being Branch Manager of Madhya Bihar Gramin Bank, Sihadi transferred Rs. 4,20,417/- to the Account of this petitioner, which was subsequently returned. It is submitted by the learned counsel for the petitioner that the transfer was made by her husband and he has deposited the alleged amount with compound interest in pursuance to the order passed in Cr. Misc. No. 10688 of 2015 to the tune of Rs. 7,33,888/-.
Considering the thrust of accusation against the
Patna High Court Cr.Misc. No.54844 of 2015 (2) dt.04-12-2015 husband of the petitioner, petitioner being a lady, statement has been made in para-3 of the petition that petitioner has no criminal antecedent and the fact that the husband of the petitioner has deposited the entire amount with the compound interest in pursuance to the order of this Court , let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sanjay Priya, Judicial Magsitrate, Ist Class, Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 126 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
