JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 307 and other allied sections of the IPC and under 27 of the Arms Act.

Counsel for the petitioner submits that the petitioner has falsely been implicated in this case as a counter blast to the earlier case lodged against the informant party bearing Didarganj Police Station case no. 155 of 2015. He submits that the FIR is not supported by the materials collected in the case diary during investigation. Petitioner is in custody since 29.8.2017 having no antecedent.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate 1st class, Patna city in Didarganj Police Station Case No. 164 of 2015 on the following conditions:- (i) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he

(ii) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
