2. The petitioner has preferred this application for grant of regular bail in connection with Sikrahtta P.S. Case No. 51 of 2024 dated 24.04.2024 registered for the offences punishable u/s 399, 402 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of Arms Act.

3. As per the prosecution case, two live cartridges and one motorcycle bearing Reg. No. BR-03AA-8517 have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has no concern with the recovered incriminating

Patna High Court CR. MISC. No.62160 of 2024(2) dt.18-09-2024 2/2 articles. There is no independent witness of the alleged seizure. A statement has been made in para 3 of the petition that petitioner has two antecedents. Moreover, the petitioner is languishing in judicial custody since 25.04.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Sikrahatta P.S. Case No. 51 of 2024.

7. The application stands allowed.
