2. The petitioner seeks regular bail in connection with Piprakothi P.S. Case No.189 of 2025, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, there is recovery of 150 liter country made liquor from the bush near Chhaurahiya Ghat.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case only on the basis of suspicion. He further submits that no incriminating article has been recovered from the conscious possession of petitioner or from his house. Learned counsel
Patna High Court CR. MISC. No.56171 of 2025(2) dt.20-08-2025 2/2 submits that the alleged recovery has been made from a bush near Chhaurahiya Ghat which is an open place and is accessible to public at large. He further submits that petitioner is in custody since 19.06.2025 having clean antecedent. Learned counsel submits that there is no chance of absconding the petitioner or tampering with the evidence and he undertakes to cooperate in the investigation and trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Motihari, East Champaran in connection with Piprakothi P.S.
