The petitioner is languishing in custody in connection with Ara Muffasil P.S. Case No. 24 of 2012 for the offences instituted under Sections 302, 201/34 of the Indian Penal Code. Earlier bail application of the petitioner was rejected vide Cr. Misc. No. 29808 of 2012 dated 01.11.2012. This is third attempt for grant of bail on behalf of the petitioner. A report was called for from the Court below regarding the stage of the case and same is marked as flag 'A'. Four witnesses have already been examined and against the rest process has already been issued. It is expected that within six months the trial will be concluded.

No.17829 of 2016 (3) dt.02-08-2016 2/3 The prosecution story in brief, is that the marriage of the informant's sister was solemnized nine years back with petitioner, in previous month his sister was tortured for demand of cow by in-laws and thereafter informant gone to enquire the matter and saw that his sister died and dead body was cremated. The informant suspected that his sister done to death by his husband, mother-in-law and father-in-law and dead body is traceless.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.04.2012 and he is the husband of the deceased.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in S.Tr No. 181 of 2013 arising out of Ara Muffasil P.S. Case No. 24 of 2012, pending in the court of learned 2nd Ad-hoc Additional Sessions Judge, Bhojpur at Ara. Anyhow, the court below is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of copy of this order.
The Superintendent of Police, Bhojpur at Ara is also
Patna High Court Cr.Misc. No.17829 of 2016 (3) dt.02-08-2016 3/3 directed to ensure that the witnesses are produced on the date fixed by the trial court so that trial could be concluded within the stipulated period.
Let a copy of this order be communicated to the Superintendent of Police, Bhojpur at Ara.
