The petitioner seeks regular bail in connection with Tr. No.1717 of 2018 arising out of Mufasil (Motihari) P.S. Case No. 592 of 2017 for the offences punishable under Sections 302 and 120B of the Indian Penal Code.
The allegation is regarding the son of the informant having been called by a girl telephonically in the night of the day of occurrence, whereafter the deceased had gone away from his house and he did not return. On search the informant was informed that his son has been murdered.
The learned counsel for the petitioner submits that the entire case diary as also the material on record would show that the petitioner was beaten by the villagers and as far as the
Patna High Court Cr.Misc. No.23924 of 2018 (3) dt.02-07-2018 2/2 petitioner is concerned, there is no allegation of any specific overt act resulting in the death of son of the informant. The petitioner is stated to be languishing in custody since 06.01.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sadar East-Champaran at Motihari in connection with Tr. No.1717/2018 arising out of Mufasil Motihari P.S. Case No. 592 of 2017.
