JUSTICE SUDHIR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 417, 365, 369, 374, 364/34 of the Indian Penal Code.
Allegation against the petitioners is that they hatched a conspiracy and concealed the son of the informant in order to get money or grab the land and other properties of the informant. It is submitted on behalf of the petitioners that they have got no criminal antecedent. It has been submitted that there is no specific allegation against the petitioners. As per prosecution case, co-accused Mumtaz is said to have assured the victim regarding employment at Delhi. The said Mumtaz has been granted anticipatory bail vide Cr. Misc. no. 37350 of 2015. On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.55386 of 2015 (3) dt.20-01-2016 2 / 2 above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria, in connection with Jokihat( Mahalgaon) P.S. Case no. 166 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
