1. Heard learned Counsel for the petitioner, learned Counsel for the complainant-Opposite Party No. 2 and learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 690 of 2022, registered for the offences punishable under Section 498-A of the Indian Penal Code.
3. The matter was referred for mediation by this Court and a report of learned Mediator dated 09.02.2024 says that the parties have resolved their dispute and have amicably settled the same. A memorandum of agreement has been signed by the parties on 09.02.2024.
4. Learned counsel for the opposite party No. 2 does not dispute the submission made by the learned counsel for
Patna High Court CR. MISC. No.60088 of 2023(3) dt.27-02-2024 2/2 the petitioner.
5. Having heard learned Counsel for the parties and taking into consideration the memorandum of agreement arrived between the parties before the learned Mediator, I am inclined to grant the petitioner privilege of anticipatory bail subject to the condition that the petitioner shall abide by the terms and and conditions of agreement dated 09.02.2024.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Complaint Case No. 690 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
