Learned counsel for the State is present.

From perusal of the record, it would be evident that on 19th December, 2013, when the case was called out, none appeared on behalf of the petitioner to press the application. However, the matter was adjourned and thereafter, on 11.2.2014, when the matter was called out, once again none appeared to press the application and accordingly, the application was dismissed for want of non-prosecution. Subsequently, an application for restoration of writ petition was

Patna High Court Cr. WJC No.733 of 2013 (5) dt.13-01-2016 2/2 filed vide MJC No. 1122 of 2014, which was allowed by this Court on 02.12.2015, pursuant to which the writ petition was restored. However, after restoration of the writ application, when the matter was repeatedly called out today, once again, none has appeared on behalf of the petitioner to press the application.

In that view of the matter, I am of the opinion that the petitioner has no interest in the present application. Accordingly, the application is dismissed for want of prosecution.
