The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 407, 411, 413/34 of the Indian Penal Code and section 7 of the Essential Commodities Act.

It is alleged that the drivers of the trucks and others used to sell the FCI's grains in the black market when several persons were apprehended. It transpired that the petitioner used to purchase the FCI supple and sell in the black market. It is submitted by learned counsel for the petitioner that admittedly no recovery has been made from the petitioner and merely on suspicion the accusation has been levelled. Two other cases have also been lodged with similar accusation on

Patna High Court Cr.Misc. No.54921 of 2015 (2) dt.04-12-2015 2/2 suspicion.

Considering the suspicious nature of accusation, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, preferably on the same day, if the petitioner surrenders within a period of six weeks in connection with Mokama P.S. Case No.278 of 2013, pending before the learned SDJM, Barh, Patna.

With the above observation, this application is, accordingly, disposed off.
