JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-10-2019 The petitioner retired as Panchayat Secretary in the year 2012. It is his claim that because of non-receipt of last pay certificate, he was paid his salary on the basis of basic scale without allowing him benefit of any increment. The period, for which the petitioner is claiming more salary than that was paid to him, ranges from December, 2001 till the date of his retirement in January, 2012.

This writ application has been filed slightly less than eight years after the date of petitioner's superannuation. The petitioner is seeking direction for payment of the dues, which he

Considering the inordinate delay in approaching this Court seeking the relief, as noted above, I am not inclined to pass any positive order. It is, however, observed that the petitioner shall be at liberty to pursue his grievance before District Magistrate, Muzaffarpur, by making a representation, which shall be considered in accordance with law.
