The petitioner questions the eligibility of respondent no.5 to contest the election to the post of Chairman, Bellor Agriculture Credit Cooperative Society in the district of Saran. The question whether a person is eligible or not eligible to contest the election is an election dispute to be raised under section 48 of the Bihar Cooperative Societies Act, 1935 read with the provisions of the Bihar State Election Authority Act, 2008 and the petitioners shall be at liberty to take recourse to the same.

The writ petition is disposed of accordingly. Any such application filed by the petitioners within

Patna High Court CWJC No.261 of 2015 (2) dt.12-02-2015 four weeks from today if accompanied with a petition for condonation of delay, shall be considered and disposed of by the appropriate authority in accordance with law and on its own merits bearing in mind the pendency of the issue before this Court.
