JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 324, 337, 379 and 504 of the Indian Penal Code.

The prosecution case is that the informant slipped on the road due to waste water being flowed by the accused persons and on protest being made, co-accused Rajeev Ranjan assaulted with lathi on the head of the informant when informant raised alarm his nephew came who was being assaulted by petitioner no.1, Ajay Kumar Ram and thereafter all the accused persons including the petitioners assaulted the informant. It is further alleged that coaccused Pankaj Kumar Ram and petitioner no.2 Vijay Kumar snatched `4,000/- and watch of the informant.

No.57060 of 2015 (2) dt.18-12-2015 2/2 It is submitted by learned counsel for the petitioners that the specific accusation of making assault to the informant is against Rajeev Kumar Ranjan when the injury report of the informant reflects only one injury whereas the nephew of the informant received two injuries but both injuries have been found to be simple superficial in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the genesis of occurrence and nature of injuries, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Maharajganj P.S. Case No. 129 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
