The petitioner seeks bail in connection with G.O. Case No. 314 of 2021 instituted for the offences under Sections 30(a) and 32(3) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.10.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 135 litres of liquor from a Tata Magic.

No.67106 of 2021(2) dt.18-02-2022 2/2 Learned counsel for the petitioner submits that neither the liquor nor the vehicle belongs to the petitioner, nor he was the driver of the said vehicle rather he had taken lift in the vehicle and came to be implicated when search was made. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.10.2021, is a person with clean antecedent, prosecution report has been submitted in the case and is neither the owner nor the driver of the vehicle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with G.O. Case No. 314 of 2021.
