JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant within one and half year of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the victim was suffering from chronic lung disease. The postmortem was conducted by the doctor, who found no external injury. It is further submitted that viscera has been kept reserved. Moreover, the thrust of accusation is against the husband of the victim.
Considering the thrust of accusation against the husband
Patna High Court Cr.Misc. No.55267 of 2015 (2) dt.07-12-2015 2/2 of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dudnagar, Aurangabad in connection with Obra P.S. Case No.94 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
