2. Petitioner seeks bail for the offence punishable under Sections 30(a), 32(1), 32(2), 38, 41(1) and 41(2) of the Bihar Prohibition and Excise Act.
3 . As per prosecution case, 572 liters spirit was recovered from the cattle yard of the petitioner and 650 litres spirit was recovered from poultry farm of this petitioner.
4. Learned counsel appearing for the petitioner submits petitioner is innocent and has falsely been implicated in the present case. The cattle yard and the poultry farm in question from where the alleged recovery has been made is an open place . Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 23.07.2024 .

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Exclusive Special Excise Judge Saran at Chapra in connection with Madhaurah ( Marhowrah) P.
