The petitioner seeks regular bail in connection with Medni Chauki P.S. Case No. 23 of 2017, S. Tr. No. 200/2017 for the offences punishable under Section 364 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner having conspired and killed the deceased on account of the deceased having bad eye on the sister of the petitioner.
The learned counsel for the petitioner submits that the dead body of the deceased was recovered upon disclosure made by Md. Jahangir who had filed a bail petition bearing Criminal Misc. No. 53060 of 2017 and this Court vide order dated 14.11.2017 had
Patna High Court Cr.Misc. No.24619 of 2018 (4) dt.04-07-2018 2/2 directed the concerned court below to verify the submission of the petitioner from the cases dairy and in case the same is found to be correct, then grant bail to the petitioner. It is submitted that thereafter the submission of the said Md. Jahangir made before the court has been verified and the said Md. Jahangir has been granted bail. The petitioner is stated to be having a clean antecedent and is languishing in custody since 08.04.2017.
Having regard to the facts and circumstances of the case as also the fact that the main accused i.e. Md. Jahangir has been released on regular bail, I deem it fit and appropriate to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2 & Special Judge, Lakhisarai in connection with Medani Chauki P.S. Case No. 23 of 2017.
