Petitioner is an accused in a case registered for offence under Sections 25(1-b) (a), 26 and 35 of the Arms Act. It is submitted that the instant case, as well as Tajpur P.S. Case No.336 of 2017 under Sections 147, 148, 149, 307, 323, 365, 363, 120B of the Indian Penal Code and Section 4 of the POCSO Act, are arising out of the same occurrence. Petitioner is already on bail in Tajpur P.S. Case No.336 of 2017 by order dated 6.4.2018 in Cr. Misc. No.13915 of 2018. On the basis of false allegation of recovery of country made rifle and two cartridges, he has been in custody in connection with this case since 17.10.2017. Considering the aforesaid submissions, prayer for
Patna High Court Cr.Misc. No.24334 of 2018 (3) dt.24-05-2018 2/2 bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in Tajpur P.S. Case No.337 of 2017 on the following conditions : - One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
