JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 22-10-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned AC to AAG-6 appearing on behalf of the respondent nos. 1 to 3, seeks permission to withdraw the present writ petition with a liberty to approach the Circle Officer, Mohra Block, in the District of Gaya under Section 3 of The Bihar Land Mutation Act, 2011 ( in short 'Act, 2011') by filing a proper petition in a prescribed format, after impleading all the necessary parties including the private respondents herein, for grant of appropriate relief(s) to the petitioner with respect to the lands in question. Permission is accorded.
The writ petition stands disposed of as withdrawn with the liberty aforesaid.
If an appropriate petition under Section 3 of the Act,
Patna High Court CWJC No.20775 of 2014 (2) dt.22-10-2016 2/2 2011 is filed in the manner indicated above, then the respondent Circle Officer shall be obliged to register a case for mutation of the name of the petitioner with respect to the lands in question and that shall be taken to its logical conclusion in accordance with law, but before passing any final order, reasonable opportunity of hearing must be given to all concerned including the petitioner and the private respondent nos. 4 to 7, besides others, if any.
