JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Sahar P.S.Case No. 37/2013 instituted under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code, pending in the .Court of learned C.J.M., Bhojpur,Ara.
Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner has got his appointment in the name of another person and worked from 17.9.2009 to October, 2011 in Primary Health Centre as Anusewak.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case It is further submitted that a false case, at the instance of District Magistrate and Civil Surgeon, has been brought against him.
Patna High Court Cr.Misc. No.49567 of 2014 (3) dt.30-04-2015 2/2 On behalf of the State, it is submitted that there is specific allegation against the petitioner for committing fraud in respect of his appointment.
Considering the aforesaid facts, I am not inclined to grant privilege of anticipatory bail to the petitioner. The payer for anticipatory bail of the petitioner is rejected. However, if the petitioner surrenders in the court below within six weeks and pray for regular bail, the same shall be considered on its own merit without being prejudiced by this order of rejection.
