This application for anticipatory bail arises out of Special Case No. 1351 of 2021 arising out of Mehandiganj P.S. Case No. 23 of 2021 for the offence punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.1, above named.

Accordingly, this bail application is dismissed as

Patna High Court CR. MISC. No.68256 of 2021(2) dt.24-12-2021 2/2 withdrawn as against petitioner no.1, above named, only. It is submitted by the counsel of the petitioners that the petitioner no.2 has falsely been implicated in this case merely on suspicion.

Let the petitioner no. 2, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna, in connection with Special Case No. 1351 of 2021 arising out of Mehandiganj P.S. Case No. 23 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
