JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Majhauliya PS case no. 26 of 2018 instituted for the offences punishable under Sections 304(B), 201/34 of Indian Penal Code. The allegation is regarding the petitioner having killed his wife on account of non-fulfilment of demand for dowry. The learned counsel for the petitioner, referring to paragraph no. 45 of the case diary has submitted that the informant herself has stated before the police that she had, under a false notion, lodged the FIR against the petitioner and infact, the matter has also been compromised and settled amongst them.
Patna High Court Cr.Misc. No.25976 of 2018 (3) dt.05-07-2018 In view of the submission of the learned counsel for the petitioner, I deem it fit and appropriate to direct the concerned court to issue notice to the informant and verify about the exact position vis-a-vis the aforesaid submission of the learned counsel for the petitioner. If the aforesaid submission made by the learned counsel for the petitioner is found correct, the learned trial court shall grant bail to the petitioner upon such terms and conditions as it may deem fit and proper to be imposed upon the petitioner. The aforesaid exercise should be completed within a period of four weeks from today.
