JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

The accusation is kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioners that victim got her age recorded as 20 years whereas the Court assessed as such, though as per medical opinion the victim has been found aged between 17 1⁄2 to 18 1/2 years. The victim in her 164 Cr.P.C statement has stated that she of her own married with petitioner No. 2 Sheonath Sahani and gave birth to a male child and she was never been abducted.

Patna High Court Cr.Misc. No.288 of 2016 (2) dt.06-01-2016 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the 164 Cr.P.C statement of the victim, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul at Motihari in connection with Chhauradano P.S. Case No. 33 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
