JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-04-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Marauna Police Station Case No. 86 of 2015, disclosing offences under Sections 341, 323, 379, 384, 504, 506/34 of the Indian Penal Code.

It is alleged against the petitioners by the informant that he demanded Rs. 5,000/- cash and five bottles of wine per month as rangdari. The informant is said to be the salesman of a liquor shop.

Learned Counsel appearing on behalf of the petitioners has submitted that the petitioners have no criminal antecedent and false case has been instituted because of some pending dispute between the informant and the petitioners. He has also submitted that the wife of

Be that as it may, considering the fact that the petitioners have no criminal antecedent and keeping in view the nature of allegation, this application is allowed. Let the petitioners, namely, Ram Bilas Sah @ Ram Bilash Sah @ Ram Bilash Sahu and Santosh Sah @ Santosh Kumar Sahu, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Marauna Police Station Case No. 86 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
