The petitioner seeks bail in connection with Pasraha P.S. Case No. 94 of 2021 giving rise to Special B.A. (Excise) No. 734 of 2021 instituted for the offences under Section 30(a) of the Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 382.980 litres of liquor from the banana field of one Sanjay Yadav.

Learned counsel for the petitioner submits that the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 02.09.2021, is a person with clean antecedent, chargesheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise, Khagaria in connection with Pasraha P.S.
