JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2018 The petitioner seeks bail in connection with Rosera P.S. Case No. 220 of 2017 instituted for the offence under Section 392 of the Indian Penal Code.
Four mobile telephones and Rs. 9000/- were taken away from the shop of the informant.
The petitioner is not named in the F.I.R and his complicity in the present case surfaced only on the confession of the co-accused Vinod Kumar Das. From the house of aforesaid Vinod Kumar Das, stolen articles were recovered. The learned counsel for the petitioner has submitted that nothing has been recovered from the conscious possession of the petitioner and he has also not been put on Test Identification Parade.
Patna High Court Cr.Misc. No.25613 of 2018 (3) dt.17-05-2018 2/2 The petitioner is in custody since 19.11.2017 and does not have any criminal antecedent.
For the aforestated facts, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Rosera P.S. Case No. 220 of 2017.
