JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Nalanda PS Case No. 113 of 2016 registered under Section 306 of the IPC. The allegation in brief is that the informant's son committed suicide and a suicide note was found from his pocket giving reason for committing suicide that One lakh fifty thousand rupees was taken by the petitioner which was not being returned. Learned Counsel for the petitioner submits that the suicide note is not of the deceased, moreover there is no instigation on the part of the petitioner who is in custody since 31.10.2017 and the petitioner has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Suman Kumar Bharti @ Ravi Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda in connection with Nalanda PS Case No. 113 of 2016.
