JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-07-2018 The petitioner, who is a juvenile has approached this Court through his father for his release from remand home where he has been lodged in connection with Doriganj P.S. Case No. 228 of 2017 dated 19.11.2017, instituted for the offences under Sections 461, 379, 411 of the Indian Penal Code.
The name of the petitioner/juvenile transpired in the confession of a co-accused and thereafter in his own confession. Certain stolen articles are also said to have been recovered from his possession.
Be that as it may, he has remained in the remand home since 23.11.2017.
The social investigation report though describes him an offensive person who is likely to fall in bad company but no reason has been assigned to come to this conclusion. Considering the aforestated facts, the order dated
Patna High Court CR. REV. No.441 of 2018 (2) dt.12-07-2018 2/2 30.01.2018 passed by the Juvenile Justice Board, Chapra in J.J.B. Case No. 1261 of 2018, arising out of Doriganj P.S. Case No. 228 of 2017, rejecting the prayer of the petitioner/juvenile for being released from juvenile home as well as the order dated 17.02.2018 passed by the learned 1st Additional District & Sessions Judge, Saran at Chapra in Cr. (Juvenile) Appeal No. 5 of 2018, affirming the aforesaid order, are set aside.
The petitioner/juvenile, above named, is directed to be released on his furnishing bond in the sum of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal Magistrate, Juvenile Justice Board, Saran at Chapra in connection with J.J.B. Case No. 1261 of 2018, arising out of Doriganj P.S. Case No. 228 of 2017.
One of the bailors shall be the father of the petitioner, who at the time of filing of his bonds shall furnish an undertaking that he shall take good care of his son and shall report about any disobedience of his son to the Officer-incharge of the concerned Police Station immediately. The present revision petition is accordingly allowed. (Ashutosh Kumar, J) Shageer/- U T
