JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 341, 323, 307/34, 498 (A) and 304 B of the I.P.C and section 3⁄4 of the Dowry Prohibition Act The daughter of the informant was married with coaccused Arjun Singh on 20.02.2014 and after marriage the husband and other in-laws started demanding dowry and due to non fulfillment she was burnt to death.

Submission is of false implication and that against the petitioners there is no specific allegation. Petitioner no.1 is

Patna High Court Cr.Misc. No.49862 of 2014 (2) dt.09-04-2015 2/2 mother-in-law and petitioner no.2 is Nanad. They have got no concern with the family affairs of the deceased and her husband. There is no allegation of demanding dowry. When the deceased was preparing meal fire caught her and to rescue her the petitioner Saraswati Devi also received burn injury and as such the petitioners deserve sympathetic consideration, to which the learned A.P.P. opposes.

Considering that the petitioners are mother-in-law and Nanad and there is no specific allegation against them and as such the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Siwan in Barhariya P.S. Case No. 227 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
