The petitioner, who is in custody, seeks bail in connection with Bhagwanpur P.S. Case No. 171 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

Informant is the driver of Mahindra Pick-up van who in his fardbeyan on 22.09.2017 had stated that on previous day i.e. 21.09.2017 at about 9:00 PM in the night after loading articles on his van he proceeded from Patna City to Motihari and about 11:20 PM in night he parked the vehicle and went to attend the call of nature and when he returned he could not find his pick-up van there and tried to search the van but same was not located and

Patna High Court Cr.Misc. No.1252 of 2018 (3) dt.05-02-2018 2/2 thereafter on next day FIR was lodged. FIR is against unknown. The name of the petitioner has surfaced on the basis of confessional statement made by Sonu Kumar and except that confessional statement there is no incriminating material against the petitioner. Nothing has been recovered from his possession and he is in custody since 10.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Vaishali at Hajipur, in connection with Bhagwanpur P.S.
