JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Mahammadpur P.S. Case No. 38 of 2016 instituted for the offences under Sections 398, 326, 307 of the Indian Penal Code and Section 27 of the Arms Act.

An attempt was made to snatch the vehicle of the informant and in that process, he was fired at and injured. The F.I.R was registered against unknown. The name of the petitioner in the present case transpired on the confession of a co-accused.

The learned counsel for the petitioner has submitted that but for the name of the petitioner transpiring in the confession of a co-accused, there is no other material to connect the petitioner with the crime. It has further been

No.25940 of 2018 (2) dt.18-05-2018 2/2 submitted that because the petitioner has earlier been made accused in number of cases, the police, without any reason has implicated him in the present case. In all the cases in which the petitioner has earlier been made accused, he has been granted bail. In fact, one of such cases has ended in acquittal.

The petitioner is in custody since 27.05.2017. For the aforestated facts specially the period of custody of the petitioner, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gopalganj in connection with Mahammadpur P.S. Case No. 38 of 2016.
