JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the son of the informant Ajit Kumar was surrounded by the petitioner, co-accused Sidheswar Singh and Sanjay Singh. On protest being made by the son of the informant, on the order of the petitioner, Sanjay Singh caused fire arm injury to the son of the informant and, thereafter, co-accused Sidheswar Singh assaulted him by means of 'lathi.
It is submitted by learned counsel for the petitioner that the accusation of assault is not levelled against the petitioner. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.60 of 2016 (2) dt.05-01-2016 2/2 Considering that the accusation of assault is not levelled against this petitioner, let him be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda in connection with Noor Sarai P.S. Case No.227/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
