JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 323, 341 and 354 of the Indian Penal Code.
Allegation against the petitioner is that he made an attempt to commit rape upon complainant. When this fact was informed to the police, she was beaten by the petitioner. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. From perusal of Annexure-2 it is evident that the matter was enquired by the S.H.O., Mahila P.S. Darbhanga and it was found that the present case has been instituted due to land dispute between the parties.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances and Annexure-2 to the present application, let the above named petitioner, in the event of arrest or surrender in the court below
Patna High Court Cr.Misc. No.15687 of 2016 (2) dt.03-05-2016 2/2 within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Complaint Case no. 824 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
