JUSTICE MADHURESH PRASAD ORAL ORDER 03-05-2018 Heard counsel for the petitioner and APP for the State. Petitioner is an accused in a case registered for offence under sections 302/201/506/34 IPC.

Learned counsel for the petitioner submits that merely upon recovery of a dead body of the victim from a mango tree the petitioner has been implicated in this case on the basis of suspicion as there is subsisting land dispute between the deceased and the petitioner. Prior to the lodging of this case, he is not accused in other case, though the deceased was a man of criminal antecedent and was facing trial in criminal cases. Petitioner is in custody in connection with this case since 14.12.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the

No.17694 of 2018 (3) dt.03-05-2018 satisfaction of Additional Chief Judicial Magistrate IV, Madhubani in Ladaniya Police Station Case No. 228 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
