JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report and it appears that name of this petitioner came in this case in confessional statement of co-accused Dinanath Sahani and after that petitioner was remanded in this case from another case. Admittedly, nothing was recovered from conscious possession of the petitioner nor petitioner was put on test identification parade. It appears that except the above stated material as well as criminal antecedent of the petitioner, there appears to be nothing against him. Moreover, the investigation against the

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Motihari in connection with Kesaria P.S. Case No. 172 of 2018.
