The petitioner seeks regular bail in connection with Vaishali P.S. Case No. 305 of 2017 instituted for the offences under Sections 30(A), 32(2) and 41(i) of the Bihar Excise Prohibition Act, 2016.

Allegation is that upon the petitioner being apprehended, 25 litres of illicit liquor was recovered from his possession. It has been further alleged that various quantities of liquor was recovered from the co-accused person as also from nearby field. The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner has a clean antecedent and he is in custody since 27.11.2017.

Patna High Court Cr.Misc. No.456 of 2018 (2) dt.19-01-2018 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd,-cum-Special Judge, Excise Act, Hajipur in connection with Vaishali P.S. Case No. 305 of 2017.
