Petitioner, already in custody, seeks bail in connection with Bangra P.S. Case No.61 of 2015 registered under Section 394 of the Indian Penal Code.

Allegation in brief is that some unknown miscreants committed dacoity in the petrol pump of the informant. Learned counsel for the petitioner submits that the FIR is against unknown and no incriminating material has been recovered from possession of the petitioner, even he was not put on TIP and the petitioner has been in custody since 17.11.2016, though the petitioner has criminal antecedent but in all cases he is on bail.

No.27639 of 2018(4) dt.16-07-2018 2/2 Having considered the aforesaid facts and circumstances and the period of custody, petitioner Chandra Prakash @ Chandra Prakash Mahato is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Bangra P.S. Case No.61 of 2015 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
