JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in connection with Sessions Trial No. 345 of 2018 (Arising out of Chakia P.S. Case No. 326 of 2017), for the offences under Sections 302, 303, 34 of IPC and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is of firing on the deceased, causing his death. Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 10.10.2018, passed in Criminal Misc. No. 57826 of 2018.

Submission of learned counsel for the petitioner is that no injury was found as alleged of firing. Petitioner is in custody since 07.02.2018.

Heard learned APP also.

Having heard both sides, in view of the allegation of

Patna High Court CR. MISC. No.53545 of 2019(2) dt.28-08-2019 2/2 firing against the petitioner and other accused persons and several fire arm injuries were found on the dead body of the deceased, I am not inclined to grant privilege of bail to the petitioner. However, since the petitioner is in custody since 07.02.2018, the learned trial court is directed to conclude the trial as soon as possible.
