The petitioner is languishing in custody since 02.01.2016 in a case registered for the offences punishable under Sections 20, 21 and 22 of the NDPS Act.

From the tobacco shop of the petitioner's brother Munna four kgs. Ganja were recovered. The petitioner was also found present in the shop.

It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner. The petitioner has no criminal antecedent, statement to that effect has been made in paragraph 3 of the petition and the investigation has already concluded. Mr. J.N. Thakur learned APP submits that the

Considering the recovery of the contraband between small and commercial quantity, the petitioner has no criminal antecedent and the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II -cum- Special Judge, NDPS, Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 01 of 2016. The learned court below will be at liberty to cancel the bail bonds of the petitioner if he substantially gets involved in similar nature of offence.
