Petitioner seeks bail in a case registered under Sections 419, 420, 468, 120B of Indian Penal Code. Petitioner's counsel submits that the alleged amount of extorted money of Rs 10 lacs was deposited in the account of Rajive Ranjan who has, in his statement, implicated Moti Kumar. Counsel for the petitioner submits that due to enmity with the said Moti Kumar, petitioner has been falsely implicated in this case even though there is nothing on record to connect the petitioner with the occurrence nor any recovery has been made from his possession. On the basis of such allegations, the petitioner is in custody since 10.10.2017 though he has no criminal antecedent. It is further submitted that the investigation in this case is complete. Considering the aforesaid submissions, prayer for

Patna High Court Cr.Misc. No.666 of 2018 (2) dt.11-01-2018 2/2 bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in Sheohar Police Station Case No 171 of 2017 dated 02.10.2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
