The petitioner seeks bail in a case registered for the offence under Section 307, 379 and other allied sections of the Indian Penal Code as well as Section 27 of the Arms Act. As per the F.I.R., this petitioner fired from his country-made pistol on one Kamal Kant Kumar, who sustained bullet injury on his back.

It is submitted on behalf of petitioner that there is case and counter case and both sides sustained injuries. Till date, the injured witness has not been examined by the investigating officer and petitioner is in custody since 11.09.2021. However, learned A.P.P. for the State opposed the prayer for bail and submitted that there is direct and specific allegation against this petitioner of giving fire-arm injury to

Patna High Court CR. MISC. No.67246 of 2021(3) dt.18-04-2022 2/2 Kamal Kant Kumar and doctor has also found fire-arm injury on the person of said Kamal Kant Kumar.

In view of specific allegation against this petitioner of causing fire-arm injury, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
