The petitioner seeks bail in connection with Naubatpur P.S. Case No. 418 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that allegation is of recovery of 60 litres of country-made liquor. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came in the confessional statement of co-accused, Lal Mohan Paswan

Patna High Court CR. MISC. No.67011 of 2021(2) dt.18-02-2022 2/2 which has no evidentiary value in the eyes of law. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.08.2021, charge-sheet has been submitted in the case and his name transpired in the confessional statement of coaccused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Naubatpur P.S. Case No. 418 of 2021.
