JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-02-2015 This application under Section 482 of the Code of Criminal Procedure has been filed for modification of the order dated 13th October, 2014 passed in Cr. Misc. No. 34617 of 2014 whereby the case diary of Kahalgaon P.S. Case No. 103 of 2004 has been summoned. It has been contended that due to typographical error in para 1 and prayer portion of the bail petition the P.S. Case number was typed as Kahalgaon P.S. Case No. 103 of 2004 instead of Kahalgaon P.S. Case No. 109 of 2004 as a result of which while passing the aforesaid order dated 13.10.2014, case diary of Kahalgaon P.S. Case No. 103 of 2004 was summoned.

On the facts and in the circumstances of the case, the application for modification is allowed. In the order dated 13.10.2014 passed in Cr. Misc. No. 34617 of 2014, Kahalgaon

Patna High Court Cr.Misc. No.51168 of 2014 (2) dt.11-02-2015 P.S. Case No. 103 of 2004 be read as Kahalgaon P.S. Case No. 109 of 2004.

Let the order be communicated to the court of learned Special Judge (N.D.P.S. Act), Bhagalpur in connection with Kahalgaon P.S. Case No. 109 of 2004.

Learned counsel for the petitioner is permitted to make necessary corrections in para 1 and prayer portion of Cr. Misc. No. 34617 of 2014 in course of the day.
