Petitioner apprehends arrest in connection with Rajapakar (Barauti) P.S. Case No. 17/16 for offences alleged under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that petitioner assaulted him with saval causing fracture on his hand as also snatched Rs. 6200/- from his pocket. It has been submitted by the learned counsel for the petitioner that the petitioner and the informant are full brothers and there was property dispute regarding sale deed executed by one of the parties. It has further been submitted that the petitioner

Patna High Court Cr.Misc. No.17101 of 2016 (3) dt.27-04-2016 2/2 has got no criminal antecedent and, in fact, he was not even present in the village and resides outside to earn his livelihood. He further submits that due to family dispute the petitioner has falsely been implicated and the injury as caused by the petitioner on the informant speaks about saval blow on the hand. However, learned APP for the State submits that the petitioner is named in the First Information Report and opposes the prayer for bail.

Be that as it may, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Vaishali at Hajipur, in connection with Rajapakar (Barauti) P.S. Case No. 17/16, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nilu Agrawal, J.) Rajesh/- U T
