The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. Prosecution case is that the petitioner along with Shyamdeo Yadav came armed with 'lathi' and 'tangi' and brutally assaulted Masudan, Chandradeo, Sheo Shankar and Sahdeo Yadav.
It is submitted by learned counsel for the petitioner that in the background of dispute with regard to possession of jack fruit tree, the occurrence took place. There is counter version of the occurrence also and none of the injury has been found to be grievous. A statement has been made in paragraph 3
Patna High Court Cr.Misc. No.15167 of 2016 (2) dt.12-04-2016 2/2 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sono (Charka-Pathar) P.S. Case No.104/2015, pending before the learned ACJM, Jamui.
With the above observation, this application is, accordingly, disposed off.
